DiNapoli Reaches Agreement with TD Ameritrade to Expand Protections Against Discrimination

TD Ameritrade Holding Corporation, one of America’s largest online brokerage firms, has agreed to amend its equal employment opportunity policy to explicitly prohibit discrimination based on sexual orientation or gender identity nationwide, New York State Comptroller Thomas P. DiNapoli announced today.

"TD Ameritrade has sent a positive message to its employees and investors that it will not tolerate discrimination," DiNapoli said. "In today's society, companies must draw on the widest pool of talent possible to grow their businesses, and having policies in place to protect and encourage a diverse workforce is also good for shareholders. On the national level, the time has come to pass a national Employment Non-Discrimination Act to protect employees from discrimination."

DiNapoli has taken a comprehensive approach to shareholder engagement with companies on the topic of amending corporate equal employment opportunity policies to include explicit bans on discrimination based on sexual orientation or gender identity. Since 2010, DiNapoli has reached agreements with more than 30 companies to implement these policies, including:

In 2013, eighty-eight percent of Fortune 500 companies have adopted sexual-orientation anti-discrimination policies and 57 percent of Fortune 500 companies include protections for gender identity, according to the Human Rights Campaign’s Corporate Equality Index.

As of October 18, the $160.7 billion New York State Common Retirement Fund owned 513,612 shares of TD Ameritrade shares valued at $14.7 million.
