Purpose

To provide agencies with procedures for making Pre-Shift Briefing Adjustments.

Affected Employees

Supervisory staff represented by Council 82 Agency Law Enforcement Services Unit (BU31 and BU81) and Council 82 Security Supervisors Unit (BU61 and BU91 Settled) who have been in positions eligible to receive Pre-Shift Briefing in Fiscal Year 2006-07 and are employed in any of the following agencies:

  • Department of Correctional Services
  • Office of Parks, Recreation and Historic Preservation
  • State University of New York
  • Department of Environmental Conservation

Background

Chapter 114 of the Laws of 2006 which implements the Arbitration Award between New York State and Council 82 Agency Law Enforcement Services (BU31) provides a minimum annual guarantee of $1,248.00 for Pre-Shift Briefing pay for employees who occupied positions in the unit during FY 2006-07.

Chapter 4 of the Laws of 2007 which implements the 2003-2005 Arbitration Award between New York Sate and Council 82 Security Supervisors Bargaining Unit (BU61) provides a minimum annual guarantee of $1,248.00 for Pre-Shift Briefing pay for employees who occupied positions in the unit during FY 2006-07.

The Agreement between the State of New York and Department of Environmental Conservation’s Forest Rangers represented by Council 82, Bargaining Unit Codes 81 and 91 (BU81, BU91), includes information pertaining to the payment of Pre-Shift Briefing. The agreement covers the time period of 4/1/03-3/31/05.

For employees who do not have a full fiscal year in Bargaining Unit 31, 61, 81 or 91, the annual minimum guarantee is prorated at $48.00 per pay period based on the length of service in a Supervisory position during the fiscal year.

Control-D Reports

After Pay Period 1 is processed, the Control-D report NHRP 736 will be available as of 4/27/07. The report will include employees who held a position in Bargaining Units 31, 61, 81 or 91 during FY 2006-07 and whose total Pre-Shift Briefing (PS2 and PS6) amount was less than $1,248.00. The Pre-Shift Briefing amount (PS2 and PS6) actually paid in 2006-07 also will be included on the report. This amount may include any payments earned in FY 2005-06 but paid in FY 2006-07. If the employee received payments from more than one agency, the report will identify the total paid in the current agency and all other agencies.

Agency Actions

For each employee who earned less than $1,248.00 for Pre-Shift Briefing during FY 2006-07:

  • Calculate the Pre-Shift Briefing amount the employee was eligible to earn in FY 2006-07.
  • Determine the amount the employee was actually paid for Pre-Shift Briefing in FY 2006-07.
    • Using the amount identified on the report, subtract any amount that was paid in FY 2006-07 but was earned in FY 2005-06 and add any amount paid in FY 2007-08 that was actually earned in FY 2006-07. If necessary, contact the employee’s previous agency to confirm the Pre-Shift Briefing amount received.
  • Determine the amount of Pre-Shift Briefing due by subtracting the total amount paid from the amount the employee was eligible to earn.
  • Process the adjustment through the Time Entry page as follows:
    Earn Begin Date: Enter the last day of Pay Period 26L (3/28/07 for Institution or 4/4/07 for Administration) or, if the employee is Inactive or in another bargaining unit on the last day of Pay Period 26L, enter the last day paid in Bargaining Unit 31, 61, 81 or 91.
    Earn End Date: Same as the Begin Date
    Earnings Code: PS2
    Amount: The adjustment amount
