Purpose

To inform agencies of OSC's automatic processing and to provide instructions to agencies for processing Time Entry transactions.

Affected Employees

Employees in the Security Services Unit (BU 01), Council 82 Agency Law Enforcement Services Unit (BU 31), and Council 82 Security Supervisors Unit (BU 61).

Background

Settlement of PERB Case Number U-21309 between the State of New York and the New York State Correctional Officers and Police Benevolent Association, Inc., and subsequent GOER Memorandum authorize a 2003 payment under Article 20.2 Uniform Cleaning and Maintenance Allowance to employees in NYSCOPBA (BU 01), Council 82 Agency Law Enforcement Services Unit (BU 31), and Council 82 Security Supervisors Unit (BU 61).

Effective Dates

Separate check dated December 11, 2003 (Institution Agencies) and December 17, 2003 (Administration Agencies).

Payment Amount and Eligibility Criteria

The Uniform Allowance payment is $550 for full-time employees in the Security Services Unit (BU 01), Council 82 Agency Law Enforcement Services Unit (BU 31), and Council 82 Security Supervisors Unit (BU 61), except for eligible employees in Shock Incarceration Facilities (Agencies 10190,10200,10510, 10600, 10820) who will receive $600.

To be eligible, such employees must:

  • Be active on the payroll or be on Military Stipend.
  • Be in the Security Services Unit (BU 01), Council 82 Agency Law Enforcement Services Unit (BU 31), or Council 82 Security Supervisors Unit (BU 61) on the following dates:
    • - November 5, 2003 for employees in Administration agencies.
    • - November 12, 2003 for employees in Institution agencies.
  • Eligible employees working part-time are entitled to receive a prorated payment based on their part-time percentage on the eligibility date.
  • Eligible full-time employees on Sick Leave at 50 percent pay on the eligibility date are entitled to the full payment.
  • Eligible part-time employees on Sick Leave with partial pay on their eligibility date are entitled to a prorated payment based on their regular part-time percentage prior to their leave.
  • Eligible employees on an approved leave without pay on the eligibility date, except for those on Military Stipend, are eligible for the payment, provided they return to the payroll within one year of the eligibility date.
  • Employees on Military Stipend are eligible for the payment on the payment dates noted above.

NOTE: NYSCOPBA members who are on union leave should not be provided with a uniform allowance.

OSC Actions

OSC will automatically process the 2003 Uniform Allowance for eligible employees who were active on the payroll November 5, 2003 (Administration agencies) and November 12, 2003 (Institutional agencies).

Eligible employees on Military Stipend as a result of the events of 9/11/01 will not be processed automatically and therefore must be submitted by the agency.

Agency Payment Processing Instructions

For those payments not automatically processed, including those employees on Military Stipend, enter the following information on the Time Entry panel:

Earnings Begin Date: 11/05/03 or date employee returned to the payroll for Administration agencies 11/12/03 or date employee returned to the payroll for Institution agencies
Earnings End Date: 11/05/03 or Date employee returned to the payroll for Administration agencies 11/12/03 or Date employee returned to the payroll for Institution agencies
Earnings Code: UA8 (BU 01)
UA1 (BU 31)
UA1 (BU 61)
Amount: Enter payment amount

Miscellaneous Payment Information

For any separate check payment, if an employee has an additional tax amount in his/her record, the additional tax will be deducted from both the regular check and the separate check.

The Uniform Allowance is not pensionable and is not included in the calculation of overtime.

Payroll Register and Employee's Paycheck

The earnings code UA8 or UA1 and the amount will be displayed on the payroll register. The earnings description 'Uniform Allowance NU01' for earnings code UA8 and 'Uniform Allowance NU61/31' for UA1and the amount will be displayed on the employee's check stub.
