Divorce and Your Benefits

A Domestic Relations Order (DRO), whether prepared using the NYSLRS template or by an attorney, must be signed by a Supreme Court judge and entered as an official court document. NYSLRS requires a certified copy of the signed DRO, which we will keep on file. NYSLRS accepts a certification by the court, the County Clerk, or an attorney’s certification pursuant to Civil Practice Law and Rules Section 2105. NYSLRS also requires proof of divorce, such as a copy of the parties’ judgment of divorce.

Submit the DRO and a copy of the judgment of divorce to:

After receiving a signed DRO, the Legal Staff of the Matrimonial Bureau will review it to determine whether it complies with the RSSL and applicable policies and procedures. NYSLRS will send a letter to all parties and counsel of record notifying them whether the DRO has been accepted or rejected. If the DRO has been rejected, the letter will explain the reasons for rejection.

A proposed DRO may be mailed, emailed or faxed to NYSLRS for initial comment and review.
