DiNapoli Announces State Contract and Payment Actions for April 2017


State Comptroller Thomas P. DiNapoli announced today his office approved 903 contracts valued at $1.23 billion and approved nearly 4.2 million payments worth nearly $11.5 billion in April. His office also rejected 168 contracts and related transactions valued at $24.76 billion and nearly 5,900 payments valued at nearly $8.1 million due to concerns about fraud, waste or other improprieties.

Cumulatively through April for calendar year 2017, DiNapoli's office has approved 5,733 contracts valued at $17.06 billion and approved more than 14.4 million payments worth nearly $55.8 billion. His office has also rejected 777 contracts and related transactions valued at $28.15 billion and more than 14,800 payments valued at more than $37.9 million.

As the state's chief financial officer, DiNapoli's office reviews contracts for all state agencies and certain state public authorities and audits all state payments. This independent review ensures that costs are reasonable, the playing field is level and taxpayers get the best value for their money. These independent audits also help ensure payments are free from fraud, waste and improprieties.

The Comptroller's office averaged six days for contract reviews in April and two days to audit payments.

DiNapoli releases this monthly notice to provide current information about the number and types of contracts and payments by the state. This builds on his commitment to added transparency via his Open Book New York website.

Major Contracts Approved


Department of Corrections and Community Supervision

  • $1.7 million grant to Volunteers of America of Western New York Inc. for their community based residential program.
  • $996,000 grant to Saving Grace Ministries Inc. for their community based residential program.
  • $593,000 grant to Hope of Buffalo Inc. for their community based residential program.

Department of Health

  • $100 million with Public Consulting Group Inc. for professional assistance with New York state Medicaid programs.
  • $54.8 million for six capital restructuring financing grants including; $44.2 million to Montefiore New Rochelle Hospital; $4 million to Bronx Lebanon Hospital Center; and $3.2 million to Glens Falls Hospital.
  • $6 million for three adolescent pregnancy prevention grants including; $2.3 million to Mosholu Montefiore Community Center; $2 million to The Children's Aid Society; and $1.7 million to Long Island Gay and Lesbian Youth Inc.
  • $1.4 million for four health workforce retraining grants including; $463,000 to Health Care Industry Grant Corporation; $460,000 to Exponents Center for Personal & Professional Development; $460,000 to Visiting Nurse Service of New York Home Care II.

Department of Taxation & Finance

  • $13.7 million to lease 93 West Campbell Road in Rotterdam, Schenectady County from Rotterdam Ventures Inc.

Office of Temporary & Disability Assistance

  • $4 million disability advocacy grant to New York Legal Assistance Group Inc.
  • $1.5 million Empire State poverty reduction initiative grant to United Way of Long Island.
  • $1.6 million targeted Supplemental Nutrition Assistance Program outreach grant to Metropolitan Council on Jewish Poverty.

New York State Thruway Authority

  • $26.3 million with Rifenburg Construction Inc. for mill and inlay drain and safety improvements, Ontario County.
  • $17.6 million with Sealand Contractors Corp. for pavement restoration, Ontario County.
  • $9.9 million with Cold Spring Construction Co. for pavement repairs and resurfacing, Monroe, Genesee, and Erie counties.
  • $2.1 million with Parsons Brinckerhoff Inc. for construction inspection of bridges, Buffalo division.
  • $1.3 million with Laberge Engineering and Consulting Group for construction inspection of improvements, Syracuse division.

Department of Transportation

  • $109.7 million with ECCO III Enterprises Inc. for construction at Kew Gardens Interchange, Van Wyck Expressway.
  • $23 million with Intercounty Paving Associates LLC for asphalt concrete resurfacing 55.7 miles on Rte. 907H, 908M & I-678, New York City.
  • $14.2 million for 37 transportation grants including $1.2 million for passenger and rail assistance to Mohawk Adirondack & Northern Railroad Corp., $1.1 million for passenger and rail assistance to Falls Rd. Railroad Co Inc., and $904,000 to Nassau County for FEMA-funded bridge repair projects.
  • $7.8 million with Grace Industries LLC for safety improvements on Harlem River Drive, New York City.
  • $5.4 million with Bette & Cring LLC for Schenectady Rail Station rehab, Schenectady County.
  • $3.3 million with Mark Cerrone Inc. for pavement rehab and abandoned rail bridge removal on Rte. 78, Erie County.
  • $2.1 million with Long Island Railroad Company for railroad support services, phase II Kosciuszko Bridge replacement project, New York City.
  • $2 million with Bothar Construction LLC for pavement repair/resurface on Rte. 17, Johnson City, Broome County.

State University of New York

  • $3.3 million with Kone Inc. for elevator maintenance and service at SUNY Binghamton.
  • $3.2 million with Executive Parking Inc. for parking garage management at SUNY Stony Brook.
  • $1.8 million with CareFusion Solutions LLC for Pyxis software maintenance at SUNY Upstate Medical University.
  • $1.4 million with Intuitive Surgical Inc. for maintenance and repair services of two da Vinci robots at SUNY Stony Brook.
  • $1.4 million with Christopher Interiors for painting services at SUNY Purchase.
  • $381,000 with Common Application Inc. for on-line student application processing services at SUNY Buffalo.
  • $359,000 with Carrier Corporation for energy management control maintenance at SUNY New Paltz.

New York State Urban Development Corporation

  • $40 million interim development agreement to Moynihan Train Hall Developer LLC for Farley Building Empire Station Project, Manhattan.
  • $10.9 million to American Dairy Association for dairy promotion programs.
  • $1.9 million to New England Dairy Promotion Board for dairy promotion programs.

Tax Refunds

  • $2.6 billion for 2.3 million personal income tax refunds.
  • $115.1 million for 43,000 corporate and other refunds.
  • $15.4 million for 75,000 property tax freeze credits.

Empire State Development Corporation

  • $420,000 to Buffalo Bills Inc. for game day operations of the professional football team.
  • $294,000 to Genesee County Industrial Development Agency for land acquisition and infrastructure development for the Western New York Science, Technology and Advanced Manufacturing Park (STAMP).

Gaming Commission

  • $10.5 million to 24 local governments for tribal compact payments.
  • $4.3 million to 18 local governments for Tioga Downs Casino & Racing and Del Lago Resort & Casino gaming revenue distributions.

Office of General Services

  • $2.9 million for hourly-based IT services, including $1.8 million to IIT Inc., $413,000 to US Tech Solutions Inc., and $323,000 to GENESYS Consulting Services Inc.
  • $2.1 million to The Wesson Group LLC to expand Midway and RV Sites at the NYS Fairgrounds in Syracuse.

Department of Health

  • $3.8 million to OPAD Media Solutions LLC for advertising campaigns, including $3.3 million for advertising related to health insurance open enrollment.

New York State Legislature – Assembly

  • $9,000 to Rossein Associates for outside counsel related to sexual harassment policy development and investigations.

Office of Parks, Recreation and Historic Preservation

  • $897,000 to Norberto Construction Inc. for swimming pool modernization and construction at Rockland State Park.
  • $346,000 to K G Mechanical Inc. to upgrade the HVAC systems for the Clubhouse at Bethpage State Park in Nassau County.

State University of New York

  • $733,000 to SLAM Architects PC to rehab the Martha Van Rensselaer Hall at the New York State College at Cornell University in Ithaca.

Office of Temporary and Disability Assistance

  • $13.1 million in federal Home Energy Assistance Program (HEAP) benefits to assist 30,000 low-income New Yorkers with home heating or heat-related emergencies.

Department of Transportation

  • $4.4 million to Skanska-Kiewit-Ecco III JV to replace the Kosciuszko Bridge in New York City.
  • $1.5 million to Skanska Koch Inc. to rehab the Gowanus Expressway from 48th Street to the Hugh Carey Tunnel in Kings County.
  • $520,000 to The Pike Co. for design and build services at the Rochester Amtrak Train Station.
  • $428,000 to Albany County Airport Authority for improvements to the commercial aircraft hangar.
  • $200,000 to CHA Consulting Inc. for consulting services, including $170,000 for high speed rail design for the double track line from Albany to Schenectady.

Payment Rejections and Other Cost Recoveries
The Comptroller's rejection of nearly 5,900 payments valued at nearly $8.1 million included tax refunds valued at more than $5.2 million. DiNapoli's auditors also recovered more than $52,000 from vendors owing debts to the state, and held payments of nearly $206,000 pending resolution of disputes between subcontractors and prime contractors.
