Monitoring of New York City Mitchell-Lama Waiting Lists (Follow-Up Report)

The New York City Department of Housing Preservation and Development (HPD) supervises privately owned and privately managed housing developments that were created under the New York State Private Housing Finance Law (the Mitchell-Lama Law). Apartments in these developments are rented or sold through waiting lists maintained by the private housing companies. The waiting lists are to meet certain requirements and are to be monitored by HPD. In audit 2004-N-8, we examined HPD’s monitoring practices and found that, at two of the ten housing developments we visited, apartments had been given to tenants who were not on the waiting lists. We recommended that certain improvements be made in HPD’s monitoring practices, and when we followed up on these matters with HPD officials, we found they had made significant progress in implementing our recommendations.
