New Procedure to Receive Service Credit for Members of the New York State and Local Retirement System (NYSLRS) who have been Honorably Discharged or Released from Military Service

Purpose

To inform State agencies of the new procedure that must be communicated to certain employees to ensure the proper crediting of their military service towards service credit in NYSLRS.

Background

Pursuant to Federal Uniformed Services Employment and Reemployment Rights Act (USERRA), Article 20 of the Retirement and Social Security Law, and sections 242 and 243 of the New York State Military Law, employees may be entitled to service credit in NYSLRS for periods of military service.

Affected Employees

Any employee, who was federally ordered, ordered by the Governor of the State of New York or, in certain circumstances, volunteered for active military service and has since been honorably discharged or released from military service

Effective Date(s)

Immediately

Agency Actions

Agencies must inform employees who return to work from active military service that in order to ensure full NYSLRS service credit for their military service, the employee must forward a copy of their discharge papers to:
