Purpose

To inform agencies of new earnings codes and procedures for repaying compensation taken by the Deficit Reduction Plans to employees in the bargaining units listed below who leave State service.

Background

Pursuant to Section 7 of Part A of Chapter 491 of the Laws of 2011 and the Division of the Budget Bulletins B-1193 issued August 19, 2011, B-1196 issued November 8, 2011, B-1197 issued November 14, 2011, B-1198 issued February 15, 2012, B-1200 issued May 11, 2012, B-1201 issued June 22, 2012, and B-1202 issued September 19, 2012, employees who leave State service after having any temporary reductions made to compensation as the result of the Deficit Reduction Plans prior to the full repayment of such temporary reductions, shall receive a lump sum payment upon separation of unpaid deficit reduction plan monies.

Budget Bulletins B-1193 (CSEA), B-1198 (APSU), B-1200 (NYSCOBPA Arbitration Ineligible), B-1201 (Council 82) and B-1202 (NYSCOPBA Arbitration Eligible) stipulate payments of Deficit Reduction compensation taken only for State Fiscal Year 2012-2013.

Budget Bulletins B-1196 (PEF) and B-1197 (M/C) stipulate payments of Deficit Reduction compensation taken in State Fiscal Year 2011-2012 and State Fiscal Year 2012-2013.

Affected Employees

Employees in the following bargaining units who leave State service after having any temporary reductions made that are eligible for repayment as the result of the CSEA, PEF, APSU, M/C, NYSCOPBA or Council 82 Deficit Reduction Plans.

Note for APSU, NYSCOPBA and Council 82, reductions which are based on State Fiscal Year 2012-2013 are being repaid; the retroactive reductions made in State Fiscal Year 2012-2013 that were taken based upon the State Fiscal Year 2011-2012 compensation and reduction rate will not be repaid. This is consistent with the APSU, NYSCOPBA or Council 82 Deficit Reduction Plans and Budget Bulletins B-1198, B-1200, B-1201 and B-1202.

New Earnings Codes

OSC has created new Time Entry earnings codes to be used to process the repayment of the 2012-2013 CSEA, PEF, APSU, SSU, SSPU, and M/C Deficit Reduction Plans.

For the repayment of compensation related to the 2011-2012 PEF and M/C Deficit Reduction Plans, refer to Payroll Bulletin 1119. There is no repayment of compensation for CSEA, APSU, SSU or SSPU from State Fiscal Year 2011-12.

Agency Action - Determining Repayment Amount

OSC has created LOCKED_QUERY_47 (SSG_DRP_Repay) in PS Query to assist agencies in identifying the total amount of unpaid deficit reduction plan monies that must be repaid to an employee who has left State service. This locked query will also supply all deficit monies deducted for 2011-2012. Please reference bulletin #1119 for 2011-2012 repayment codes.

When the query is run, agencies will be prompted for an Emplid. The query results will provide the calendar year total for each of the 2012-2013 CSEA, PEF, APSU, SSU, SSPU, and M/C Deficit Reduction Plan earnings codes existing in the employee’s record including the new earnings codes identified above. Agencies should total separately those monies (both positive and negative) identified using the appropriate Deficit Plan earnings codes listed below. If the employee has earnings for more than one of the Deficit Reduction Plans, separate transactions must be submitted using the appropriate earnings code.

A Time Entry transaction should be submitted as follows:

Earnings Begin Date: Last date the employee was active on the payroll
Earnings End Date: Last date the employee was active on the payroll
Earn Code: D6C - if the monies are identified using the CSEA Deficit Reduction Plan earnings codes
  D6P – if the monies are identified using the PEF Deficit Reduction Plan earnings codes
  D6A - if the monies are identified using the APSU Deficit Reduction Plan earnings codes
  D6M – if the monies are identified using the M/C Deficit Reduction Plan earnings codes
  D6J - if the monies are identified using the SSU Arbitration Ineligible Deficit Reduction Plan earnings codes
  D6K - if the monies are identified using the SSPU Arbitration Ineligible Deficit Reduction Plan earnings codes
  D6L - if the monies are identified using the SSPU Arbitration Eligible Deficit Reduction Plan earnings codes
  D6S - if the monies are identified using the SSU Arbitration Eligible Deficit Reduction Plan earnings codes
