In Bulletin G-173, we advised agencies of a new procedure regarding contracts subject to MFEP as defined in Section 165.5 of the State Finance Law.

It will be the responsibility of each contracting entity to include the requisite signed stipulation (see attached) in their contract documents to ensure compliance with MFEP.

OSC will review all bid documents and contract packages to ensure compliance.

Contractor type code "C" has been established for Contract Encumbrance Requests (AC340) when adding or changing applicable contracts and should be entered for the purpose of identifying those vendors/bidders who stipulate having business operations in Northern Ireland, as defined in Section 165.5 of the State Finance Law. Remember when changing Contractor Type(s) to enter all applicable types, because whatever is entered in the field replaces what was there previously.

Exhibit 2 Non Discrimination in Employment in Northern Ireland

In accordance with section 165 of the State Finance Law, the bidder, by submission of this bid certifies that it or any individual or legal entity in which the bidder holds a 10% or greater ownership interest, or any individual or legal entity that holds a 10% or greater ownership in the bidder, either: (answer yes or no to one or both of the following, as applicable),

(1) has business operations in Northern Ireland;
